What are cookies?
Cookies are small text strings that the websites visited by the user send to their terminal (usually to the browser), where they are stored to be later retransmitted to the same websites upon the next visit by the same user. While browsing a website, the user may also receive cookies sent by different websites or web servers (so-called "third parties"), which may contain certain elements (such as images, maps, sounds, specific links to pages of other domains) present on the website being visited.
Cookies are categorized based on their purpose into "technical" cookies and "profiling" cookies:
- Technical cookies are used solely for "the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide that service" (Art. 122, paragraph 1 of the Personal Data Protection Code). They are not used for any further purposes and are usually installed directly by the website owner or operator. They can be further divided into: Navigation or session cookies, which ensure normal website navigation and use (e.g., allowing purchases or authentication to access restricted areas); Analytics cookies, which are considered technical cookies when used directly by the website manager to collect aggregated information about the number of users and how they visit the website; Functionality cookies, which allow the user to navigate based on selected criteria (e.g., language, selected products for purchase) to enhance the provided service. The installation of such cookies does not require the prior consent of users, although an information notice must still be provided in compliance with Article 13 of the Personal Data Protection Code. If only such cookies are used, the website manager may provide the notice in the most appropriate manner.
- Profiling cookies are designed to create user profiles and are used to send advertising messages aligned with the preferences expressed by the user while browsing the web. European and Italian regulations require that users be properly informed about their use and provide valid consent. Article 122 of the Personal Data Protection Code states that "storing information in a contractor’s or user’s terminal device or accessing previously stored information is permitted only if the contractor or user has given their consent after being informed through simplified means as outlined in Article 13, paragraph 3" (Art. 122, paragraph 1 of the Personal Data Protection Code).
- Based on their duration, cookies can be classified as "session" or "persistent" cookies:
- Session cookies are temporary and disappear from the user’s computer once they leave the visited site or close the browser. They are usually stored in the computer’s cache memory.
- Persistent cookies remain on the user’s computer even after the browser is closed, until their expiration date or until the user deletes them. The expiration date is set by the site that initiates them. They are often used to track user preferences so that when the user revisits the site, the stored information is read and adapted to their preferences.
- Based on their origin, cookies can be classified as "first-party" or "third-party" cookies:
- First-party cookies are sent by the website operator that the user is visiting.
- Third-party cookies are sent, via the website the user is visiting, by a third party different from the website operator. These cookies are not under the control of the site operator.
